These Terms and Conditions ("Terms") govern your use of the Human Performance website and your booking of any testing, coaching or consultation service (together, the "Services") provided by Human Performance ("we", "us", "our"). By booking a Service or using this website, you signify your acceptance of these Terms in their entirety. Should you decline to accept these Terms, we regret that you must refrain from booking or using the Services.
1. Bookings and payment
All Services are subject to availability and are confirmed only upon receipt of full payment, save where a Service is expressly advertised as payable in instalments or by subscription. Prices are stated in pounds sterling (£) and are inclusive of any applicable taxes unless stated otherwise. We reserve the right to amend our prices at any time; however, such amendments shall not affect a booking already confirmed.
It is your responsibility to ensure that any information you provide at the time of booking — including contact details and relevant health information — is accurate and complete. We accept no liability for any consequence arising from information that is inaccurate, incomplete, or withheld.
2. Cancellations and refunds
We ask that you consider your booking carefully before confirming it. Owing to the nature of the Services we provide — which include the reservation of clinical appointment time, the preparation and, in many instances, the procurement of testing materials in advance of your appointment — once a booking has been made and payment received, that booking is final and no refund shall be issued, save where required by law or expressly stated otherwise in these Terms.
We recognise that circumstances may occasionally require a change of date. Where you are unable to attend a confirmed appointment, please contact us as early as possible and we will endeavour, at our sole discretion and subject to availability, to offer a single rearrangement of your appointment free of charge. Requests to rearrange received with less than 24 hours' notice, or repeated requests to rearrange, may not be accommodated and may result in the forfeiture of the booking.
In the rare event that we are required to cancel a confirmed appointment for reasons within our control, we will offer you the choice of a rearranged appointment at the earliest convenient date or a full refund of the sum paid for that appointment.
3. Subscriptions and memberships
Certain Services, including our Optimisation membership, are offered on a recurring subscription basis. Unless expressly stated otherwise at the point of purchase, such subscriptions are subject to a minimum initial term, following which the subscription shall continue automatically for successive periods until cancelled in accordance with the terms presented to you at the point of purchase. Cancellation takes effect at the end of the then-current period; sums already paid in respect of a current period are non-refundable, consistent with Clause 2 above.
4. The nature of our services
Human Performance provides private health testing, body composition analysis, coaching and related consultation services. Our Services are intended to inform and support your understanding of your own health and performance; they do not constitute the practice of medicine, nor are they a substitute for the advice of your General Practitioner or another appropriately qualified medical professional. Where results indicate that clinical treatment may be appropriate, any such treatment shall be discussed and, where applicable, provided separately by a suitably qualified and registered practitioner, and shall be subject to its own separate terms and consent process.
You acknowledge that testing and coaching outcomes vary between individuals, and that we make no guarantee as to any particular health, fitness or performance outcome arising from use of the Services.
5. Your responsibilities
You agree to attend appointments punctually and to follow any preparatory guidance provided to you (for example, fasting requirements ahead of a blood test). Late arrival may result in a shortened appointment or the need to rearrange, at our discretion. You further agree to treat our staff, practitioners and coaches with courtesy and respect; we reserve the right to decline to provide, or to discontinue, a Service where this is not observed.
6. Limitation of liability
To the fullest extent permitted by law, our liability to you in connection with the Services is limited to the sum paid by you for the Service giving rise to the claim. Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot lawfully be excluded or limited.
7. Complaints
We take great pride in the standard of our service, and we take any complaint seriously. Delivering a seamless, high-quality experience at every stage — from booking through to your results consultation — is our priority, and we recognise that we will occasionally fall short of that standard.
If you are ever unhappy with any aspect of your experience with us, please tell us. You can reach us via our Contact page, by phone, or by emailing hello@hupx.co.uk. We aim to acknowledge every complaint within one working day, and to provide a full response within ten working days. Where a complaint cannot be resolved within that period, we will keep you informed of progress until it is.
We would always rather hear from you directly than have you leave dissatisfied, and we will treat every complaint as an opportunity to put things right and to improve our service.
8. Intellectual property
All content on this website, including text, graphics, logos and design, is the property of Human Performance or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or otherwise use such content without our prior written consent, save for your own personal, non-commercial use.
9. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute arising out of or in connection with these Terms.
10. Changes to these Terms
We may revise these Terms from time to time to reflect changes in our Services, our practices, or relevant law. The version published on this page at the time of your booking shall apply to that booking. We encourage you to review these Terms periodically.
